Terms of Service

This is our terms of service, ensure you are happy with the following terms before using Loytu

By accessing or using the Loytu platform and services (“Services”), you agree to these Terms of Service (“Terms”), our Privacy Policy, and the Data Processing Agreement.

If you do not agree to these Terms, you may not use the Services.

1. Definitions

  • “Services”: The Loytu platform, web applications, mobile applications, and related tools for managing digital loyalty cards and rewards.
  • “Business User” / “Controller”: A business or individual using the Services to manage customer loyalty programs.
  • “Customer”: The end user or consumer receiving loyalty cards or rewards from a Business User.
  • “Processor”: Loytu, which processes personal data on behalf of Business Users.

2. Acceptance of Terms

By signing up, creating an account, or using the Services, you agree to:

  1. These Terms of Service.
  2. The Loytu Privacy Policy.
  3. The Loytu Data Processing Agreement (DPA), which forms part of these Terms and is binding without a signature.

Your continued use of the Services constitutes acceptance of any updates to these documents.

3. Eligibility

  • You must be a business or legal entity with the right to enter a binding agreement.
  • Users under 18 may only use the platform under supervision of a parent or legal guardian for business purposes.

4. Account Registration

  • You must provide accurate, current information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify Loytu immediately of any unauthorized use of your account.

5. Services and Usage

  • Loytu provides a platform for businesses to create, distribute, and manage digital loyalty cards and rewards programs.
  • You may:
    • Issue digital stamp cards.
    • Add private labels to cards for internal business use.
    • Track customer progress and rewards.
  • You may not use the Services to:
    • Process Special Category Data without explicit customer consent.
    • Engage in unlawful or fraudulent activities.
    • Interfere with or disrupt the platform or other users.

6. Payment and Fees

  • Certain features may require payment. Fees will be clearly presented at signup or when purchasing add-ons.
  • All payments are non-refundable unless otherwise stated.
  • You agree to provide current billing information and authorize Loytu to charge your selected payment method.

7. Data Protection

7.1 Privacy Policy

  • The Loytu Privacy Policy explains how personal data is collected and processed.

7.2 Data Processing Agreement

  • The Loytu DPA governs how personal data entered into the platform is processed.
  • By using the Services, you accept the DPA.
  • The DPA defines the roles of Controller (you) and Processor (Loytu), Subprocessors, security measures, retention, and data subject rights.
  • Business Users determine the purposes of processing; Loytu determines the technical means of processing as part of the Services.

8. Intellectual Property

  • All content, software, and trademarks provided by Loytu remain the property of Loytu.
  • You may not copy, modify, or distribute our platform or software except as expressly authorized.
  • Business Users retain ownership of the data they enter into the platform.

9. Subprocessors

  • Loytu uses Subprocessors to provide the Services, listed at https://loytu.com/policies/subprocessors.
  • Subprocessors may process personal data on behalf of Controllers.
  • Loytu may update this list; updates are effective upon publication.

10. Termination

  • You may terminate your account at any time through the platform.
  • Loytu may suspend or terminate accounts for breach of these Terms or inactivity.
  • Upon termination, personal data will be deleted or returned according to the DPA and applicable law.

11. Warranties and Disclaimers

  • The Services are provided “as is” without warranties of any kind.
  • Loytu does not guarantee uninterrupted service or that the platform meets all business requirements.

12. Limitation of Liability

  • To the maximum extent permitted by law, Loytu is not liable for indirect, incidental, or consequential damages.
  • Loytu’s total liability for claims arising from the use of the Services shall not exceed the fees paid in the 12 months preceding the claim.

13. Governing Law

  • These Terms are governed by the laws of England and Wales.
  • Any disputes will be resolved under the jurisdiction of the English courts, unless otherwise required by local law.

14. Changes to Terms

  • Loytu may update these Terms at any time.
  • Continued use of the platform after updates constitutes acceptance.
