1. Introduction

These terms and conditions govern your use of and access to Loytu's services. By using Loytu, you agree to comply with these terms and conditions. If you do not agree with any part of these terms, please do not use our services. Loytu is a trading style of Project Pepperoni Limited, registered in the UK company number 13659153.

2. Definitions

• "Loytu" refers to the platform and services provided by Project Pepperoni Limited under the trading name Loytu.
• "User" refers to anyone who accesses and uses Loytu's services, including pet owners and service providers.
• "Service Provider" refers to individuals or businesses using Loytu for the purposes of processing / managing their pet services including but not limited to pet boarding, grooming, daycare, or walking/sitting services through the Loytu platform.
• "Website" refers to any Loytu website under the Loytu.com domain.
• "Subscription" refers to the monthly payment plan that gives users access to Loytu's premium features.

3. User Eligibility

Loytu's services are available to individuals who are at least 18 years old or the legal age of majority in their jurisdiction. By accessing or using our services, you represent and warrant that you meet the eligibility criteria outlined above. If you do not meet these criteria, please refrain from using Loytu.

4. User Responsibilities

Users of Loytu are responsible for providing accurate and up-to-date information when using our services. This includes but is not limited to providing accurate details about their pets, such as age, breed, health conditions, and vaccination history. Users are also responsible for treating service providers with respect and following any reasonable specific instructions or reasonable requirements provided by the service providers during the provision of the services.

5. Service Description

Loytu provides a platform for service providers to book and manage bookings for their services and connecting pet owners with service providers who offer pet services like pet boarding, grooming, daycare, and walking/sitting services. Service providers create profiles outlining their services, availability, and pricing. Loytu does not provide the services directly and is not responsible for the quality of the services provided by the service providers.

6. Booking Process

To book a service through Loytu, users must provide the necessary information. This includes details about the pet(s), the desired service, date(s), and any specific requirements. Users can communicate with service providers through the means published by the service providers in their profile to discuss any additional details or requirements. Users may cancel bookings subject to the cancellation policy specified by the service provider. Loytu is not responsible for any disputes or issues arising from the booking or provision of the services.

7. Payment

The subscription to Loytu's premium features is billed on a rolling monthly basis with no long-term contract. Payments are due at the beginning of each billing cycle. Users will not receive a refund if they choose to cancel or stop their subscription during a billing cycle. If Loytu cancels a user's subscription due to a breach of these terms and conditions, no refund will be provided. Loytu reserves the right to change pricing at any time or remove the free tier option. Users are responsible for any taxes or fees associated with the use of our services.

8. Intellectual Property

All intellectual property rights relating to Loytu's website and services, including but not limited to trademarks, logos, images, and content, are owned by Loytu and its licensors. Users acknowledge and agree that the use or reproduction of any such intellectual property without prior written permission from Loytu is strictly prohibited.

9. Confidentiality

Loytu is committed to maintaining the confidentiality and privacy of user information. We will handle user data in accordance with applicable data protection and privacy laws. Loytu may collect and use personal information as outlined in our Privacy Policy. By using Loytu's services, users consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy. We will not disclose user information to third parties without obtaining their explicit consent, unless required by law or if necessary for the provision of the services.

10. Limitation of Liability

Users agree that Loytu shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use or inability to use Loytu's services. Loytu does not assume responsibility for any actions, conduct, or negligence of service providers. Users understand and acknowledge that the services provided by service providers are independent of Loytu, and Loytu does not endorse, guarantee, or control the quality, safety, or legality of the services provided by service providers.

11. Indemnification

Users agree to indemnify and hold Loytu, its affiliates, directors, officers, employees, and agents harmless from and against any claims, costs, damages, liabilities, and expenses, including reasonable legal fees, arising out of or in connection with their use of Loytu's services or any violation of these terms and conditions. Users further agree to cooperate with Loytu in the defense of any such claims.

12. Governing Law

These Terms and Conditions and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws of the United Kingdom. Any legal action or proceeding arising out of or related to these Terms and Conditions shall be brought exclusively in the courts located in the United Kingdom, and all parties hereby irrevocably consent to the jurisdiction and venue of such courts.

13. Termination

Loytu reserves the right, in its sole discretion, to terminate or suspend a user's access to the services at any time and for any reason, including, but not limited to, a breach of these Terms and Conditions or fraudulent activity. In the event of termination, users will no longer have access to their account and any outstanding bookings or payments may be canceled. Loytu shall not be liable for any damages or losses resulting from such termination.

14. Modifications

Loytu reserves the right to modify or update these Terms and Conditions at any time. Users will be notified of any changes via email or through a notice on the Loytu website. It is the responsibility of users to review the updated Terms and Conditions. Continued use of the Loytu services after the effective date of any modifications shall constitute acceptance of the modified Terms and Conditions.

15. Miscellaneous

1. Entire Agreement: These Terms and Conditions constitute the entire agreement between the user and Loytu regarding the use of the services and supersede any prior agreements or understandings.
2. Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
3. Waiver: The failure of Loytu to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision.
4. Assignment: Users may not assign or transfer any rights or obligations under these Terms and Conditions without the prior written consent of Loytu. Loytu may freely assign or transfer these Terms and Conditions without restriction.
